The South Dakota Department of Labor & Regulation set forth a minimum wage increase effective January 1, 2025.
South Dakota Minimum Wage Law Update
- Minimum wage for non-tipped employees set to increase to $11.50 per hour
- Minimum wage for tipped employees set to increase to $5.75 per hour
- New minimum wage rates effective January 1, 2025
Wage and Hour Exemptions
Employees may be exempt from wage and hour laws based on criteria associated with their salary, actual duties, and skills. Exempt employees neither receive overtime pay nor qualify for minimum wage. South Dakota Labor Law Poster Updates
All businesses within the State of South Dakota must display the new “Minimum Wage” poster along with other state-mandated posting requirements where they are sufficiently accessible and viewable to all employees. This change has been reflected in our 2025 South Dakota Labor Law Poster and requires an immediate mandatory update. Failure to meet compliance requirements and display the updated poster could result in fines.
